Muscat, Jun.16 (ONA) ---- The Sultanate will cancel No-Objection-Certificate (NOC) for expat workers who wish to transfer their services to different sponsors upon the end or termination of their services with existing sponsors.  The decision to cancel NOCs will be enforced from the start of next year (2021) with the aim of making the labour market more attractive and competitive, as well as correcting its conditions.
    The Sultanate’s approach originates from the economic and social principles stated in the Basic Law of the State, as well as mandates of the International Covenant on Social, Economic and Cultural Rights, which the Sultanate joined on the April 7th  2020 vide provisions cited under Royal Decree No.46/2020.
    The decision will achieve many positive outcomes, both for workers and employers, including:
·       Endorsing contracts that regulate contractual relationships between the two parties.
·       Protecting the confidentiality of employers’ information and client data.
·       Ensuring employers’ rights to offset damaging competition from firms specializing in the same field.
·       Enhancing competitiveness of Omani workforce, compared to non-Omani, through the reduction of a gap in payment and other rights.
·       Cutting down the rate of absconding of expat labour.
·       Protecting the rights of expat workers who come under pressure from some employers who use NOC to deprive quitting expats from working in the Sultanate for two years after the termination of their services.
·       Cutting down administrative costs and diminishing burdens resulting from the “repatriation and settlement of legal status”.
·       Supporting the Sultanate’s efforts to control illicit trade as some employers who exploit the condition of NOC in practicing covert business (outside legal frameworks).
·       Furnishing grounds for a local labour market for local talents who can now enjoy mechanisms of demand and display.
·       Enhancing the Sultanate’s status vis-à-vis international organisations that protect labour rights and combat human trafficking.
·       Ushering in a new stage of employer-employee relationship based on laws organizing work and residency.
·       Introducing contracts that form a legal basis for clear-cut rights and obligations, as well as litigation and settlement of labour disputes.
·       Allowing ample time (till the start of 2021) for employers to adjust their legal status.
·       Allowing employers to sign non-disclosure agreement (NDA) or secrecy agreement with workers. The NDA secures the employer’s right that his employee will not move to a direct competitor after the end of the contract period.
     The decision fits with Oman Vision 2040 because the Sultanate takes certain priorities into account by addressing issues that affect its quest to be in the forefront of advanced countries.  In the past, the NOC issue, in particular, influenced Oman’s rating negatively in the Global Competitiveness Report issued by the World Economic Forum.
 
The Sultanate’s agreement to join the International Covenant on Social, Economic and Cultural Rights is considered a basic point of reference in its decision to remove the Non Objection Certificate.  His Majesty Sultan Haitham Bin Tarik issued a Royal decree on the ratification of the Sultanate’s joining the Covenant on April 7th 2020.
            Article (6) of the Covenant states that countries that are party to the Covenant shall recognize ‘the right to work’, which reserves to every individual a right to earn a living by practicing a work of his/her choice or accept it freely.  The same article requires signatories of the Covenant to take necessary action to guarantee this right.
            Article (7) of the Covenant states that the signatories (countries that are party to the Covenant) shall recognize the right of every individual to enjoy fair and satisfactory terms of employment.
